TERMS AND CONDITIONS
By accessing or using this Website, registering an account, placing an order, or making a payment through E2G, you accept and agree to be bound by these Terms in their entirety. If you do not agree, please do not use this Website.
1. INTERPRETATION
1.1 Definitions
In these Terms, unless the context otherwise requires, the following words and expressions shall have the meanings assigned to them below:
- "Working day" means any day other than a Saturday, Sunday, or public holiday in the Republic of Kenya.
- "Company" means E2G Holdings Limited, a company incorporated under the laws of Kenya, trading as EaZy to Get (E2G), with its registered office at Red Commercial Complex, Nairobi, Kenya.
- "Customer" means any individual or entity who accesses, registers on, or transacts through the Website, whether as a new or existing account holder.
- "Delivery Code" means the unique code issued to a Customer upon confirmation of a delivery, which must be presented to delivery personnel to effect final handover of the Device.
- "Device" means any mobile handset, smartphone, tablet, or related electronic product listed for sale or financing on the Website.
- "Deposit" means the upfront payment made by the Customer via M-PESA STK Push as a condition precedent to the processing of an order.
- "Installment Plan" means the daily, weekly, or periodic payment schedule applicable to a financed Device, as disclosed to the Customer at the point of order and forming part of the financing agreement.
- "Primary phone number" means the mobile telephony line registered under the Safaricom M-Pesa service and designated by the User for use on the Platform. This number shall serve as the principal account identifier, and the account holder thereof shall be exclusively responsible for all liabilities, obligations, and repayments arising from any loan facility extended under said account.
- "IPRS" means the Integrated Population Registration System maintained by the Government of Kenya, against which National ID details are verified.
- "OTP" means a One-Time Password, being a time-limited numeric code sent to a Customer's registered phone number for verification purposes.
- "Platform" means the E2G website, mobile interface, and any associated applications or services operated by the Company.
- "SKU" means Stock Keeping Unit, being the specific product identifier assigned to each Device model listed on the Platform.
- "STK Push" means SIM Toolkit Push, a mobile money payment prompt delivered to a Customer's phone number via the M-PESA platform.
- "Terms" means these Terms and Conditions, as amended from time to time.
- "Warranty" means the manufacturers or Company-backed guarantee applicable to a Device, as specified in the relevant product listing.
1.2 Interpretation Rules
- References to "includes" or "including" are not exhaustive.
- Headings are for convenience only and do not affect interpretation.
- References to any statute or statutory provision include amendments and re-enactments.
- The singular includes the plural and vice versa.
2. THE PLATFORM AND ELIGIBILITY
2.1 About E2G
EaZy to Get (E2G) is an e-commerce platform operated by E2G Holdings Limited that enables eligible Customers to purchase or finance mobile Devices through the Onfon Mobile device-financing programme. Access to the Platform and the ability to acquire Devices is subject to eligibility criteria determined by the Company.
2.2 Eligibility
To register and transact on the Platform, you must:
- be a natural person aged eighteen (18) years or older;
- hold a valid Kenyan National Identity Card;
- must maintain a valid and operational mobile phone number registered under the Safaricom M-Pesa service, alongside a functional email address, and;
- pass the Company's credit and eligibility scoring assessment.
The Company reserves the right to decline registration or cancel any transaction where these eligibility criteria are not satisfied, without obligation to provide reasons.
2.3 Geographic Scope
The Platform is operated and intended for use within the Republic of Kenya. Customers accessing the Platform from outside Kenya do so at their own risk and are responsible for compliance with applicable local laws.
3. ACCOUNT REGISTRATION AND SECURITY
3.1 New Customer Registration
To register as a new Customer, you must complete the registration form on the Platform by providing the following:
- your primary phone number registered with Safaricom which will be used to pay the deposit and activate the Device;
- your National Identity Card number;
- a valid email address for notifications and correspondence; and
- a password of your choosing, which you shall confirm upon entry.
As the primary account holder one remains responsible for all financial obligations under the Installment Plan.
3.2 Identity Verification
By submitting your registration, you expressly authorize the Company to verify your identity details, including your National ID number, against the IPRS and any other lawful verification database. You warrant that all information submitted is accurate, complete, and up to date. Submission of false or misleading information constitutes a material breach of these Terms and may result in immediate account termination and referral to relevant authorities.
3.3 OTP Verification
Registration is subject to successful OTP verification as follows:
- An OTP will be sent to your registered primary phone number following submission of the registration form.
- You must enter the correct OTP to proceed. You are permitted a maximum of three (3) attempts.
- If all three attempts are unsuccessful, your registration session will be terminated and you will be required to restart the registration process.
- A verification link will also be sent to your email address. You must verify your email to complete registration.
3.4 Existing Customer Sign-In
Existing Customers may sign in using their registered phone number, and their Password. You are responsible for maintaining the confidentiality of your login credentials. The Company shall not be liable for any loss or damage arising from unauthorized access to your account where you have failed to keep your credentials secure.
3.5 Account Responsibility
You are solely responsible for all activity conducted through your account. You agree to notify the Company immediately upon becoming aware of any unauthorized use of your account or any breach of security. The Company may suspend or terminate your account at any time where it reasonably suspects misuse, fraud, or breach of these Terms.
4. CREDIT AND ELIGIBILITY SCORING
Upon registration, the Company will carry out an automated credit or eligibility assessment to determine your qualification for device financing on the Platform. This assessment may take into account your EaZy 2 Get (E2G) usage history, repayment behaviour, and such other criteria as the Company may determine from time to time.
The Company reserves the right to:
- approve or decline your application for device financing at its sole discretion;
- determine the range of Devices for which you qualify ("qualified devices") based on your score; and
- vary the Devices available to you based on changes to your eligibility score over time.
The Company will not be obliged to disclose the specific factors or criteria used in its scoring methodology. Eligibility scores do not constitute a credit record for purposes of the Credit Reference Bureau Act or any other credit legislation.
5. ORDERING, PRICING, AND PAYMENT
5.1 Browsing and Selection
Upon logging in, you will be able to view your account profile and the Devices for which you are eligible under the inventory availability module. The Company does not guarantee the continuous availability of any specific Device or SKU. Availability is subject to stock levels and may change without notice.
5.2 Order Questionnaire
Upon selecting a Device, you will be presented with sequential confirmation statements; upon completing each response, the next statement automatically appears. You must complete to proceed to order confirmation.
5.3 Order Confirmation
Before placing an order, you will be required to confirm the following:
- the Device model (SKU);
- the total price and/or financing terms; and
- the applicable daily installment amount.
By clicking "Order Now", you confirm that you have reviewed and accepted all order details and you authorize the Company to proceed with processing your order and initiating payment.
5.4 Deposit Payment
All orders require payment of an upfront Deposit, which constitutes a condition precedent to order processing. Payment is made via STK Push to the primary registered phone number. If the STK Push payment fails, you will be offered the option to retry. The Company is not responsible for failed payments arising from insufficient funds, mobile money system downtime, or network errors attributable to third-party payment providers. A Deposit is non-refundable except as expressly provided in these Terms or as required by applicable law.
5.5 Payment Confirmation
Upon successful payment, the Company will issue a Deposit acknowledgement notification to your account inbox and registered email address. An Order Number will be generated, and an Order Trail will be initiated to enable tracking of your order.
5.6 Device Financing and Installments
All Devices are acquired on an Installment Plan: Hence,
- The Device remains the property of EaZy 2 Get (E2G) until all installments have been paid in full;
- you are obligated to maintain the Device in good working condition and ensure it is not sold, transferred, pledged, or encumbered;
- failure to make timely installment payments may result in device locking, account suspension, and recovery action; and
- the Company reserves the right to remotely restrict functionality of the Device in the event of default, as a device control mechanism.
5.7 Pricing
All prices displayed on the Platform are in Kenya Shillings (KES) and are inclusive of applicable taxes unless otherwise stated. The Company reserves the right to vary prices at any time without prior notice; however, the price applicable to your order will be the price confirmed at the time of clicking "Order Now". Pricing errors are subject to correction, and the Company may cancel orders where prices were manifestly incorrect.
6. DELIVERY
6.1 Delivery Options
Upon placing an order, you may select one of the following delivery methods:
- Door-to-door delivery: you will share your location and nearest landmark for dispatch. Delivery coverage is subject to the Company's logistics partner's service area; or
- Pick-up: you may select from available Fargo Courier locations or Onfon Mobile Service Centres.
6.2 Order Processing and Tracking
Following payment confirmation:
- your order will be placed in a processing queue;
- the system will assign a delivery date and tracking number;
- a logistics partner will be triggered and delivery personnel assigned;
- you will receive notifications containing delivery personnel details and updates via your account and registered email; and
- order tracking will be continuously updated through the Order Trail.
Estimated delivery timelines are indicative only and are subject to stock availability, logistics partner capacity, and factors beyond the Company's control. The Company shall not be liable for reasonable delays attributable to such factors.
6.3 Delivery Confirmation and Device Activation
At the point of delivery:
- the order will be marked confirmed and you will receive a Delivery Code;
- you must share the Delivery Code with the delivery personnel, who will input the code to complete delivery;
- upon code confirmation, your Device loan will be activated; and
- you will be required to insert the SIM card of your registered phone number (primary or secondary, as applicable) and ensure internet connectivity, whereupon the system will set the applicable lock time as part of the device control mechanism.
The Order Trail will be updated to "Completed" upon successful delivery and activation. A follow-up call from the Company may be scheduled to confirm your satisfaction with delivery.
6.4 Risk and Title
Risk in the Device passes to the Customer upon physical delivery and confirmation via the Delivery Code. Title, however, remains with the Company until all outstanding payments under the Installment Plan have been made in full.
6.5 Loss, Theft, and Customer Responsibility
- The Customer acknowledges and agrees that risk in the Device passes to the Customer upon successful delivery and confirmation in accordance with Clause 6.4.
- From the time risk passes, the Customer shall bear full responsibility for the safekeeping, custody, and use of the Device.
- In the event that the Device is lost, stolen, or irreparably damaged for any reason whatsoever after delivery, the Company shall have no obligation to replace the Device or provide any refund, whether in whole or in part.
- The occurrence of loss, theft, or damage to the Device shall not relieve the Customer of their obligation to continue making all payments due under the applicable Installment Plan until the Device Purchase Price and all related amounts have been paid in full.
- The Company does not provide tracking, recovery, or insurance services in respect of any Device, and shall not be liable for the location, recovery, or replacement of any lost or stolen Device.
- The Customer is advised to take all reasonable precautions to safeguard the Device, including but not limited to maintaining physical security and, where available, activating manufacturer-provided security features.
7. AFTERSALES, RETURNS, AND WARRANTY
7.1 Wrong Delivery
If you receive a Device that does not correspond to your order, you must:
- accept delivery and complete the delivery confirmation process;
- immediately log a return request through your account, selecting the applicable reason from the drop-down menu; and
- Cooperate with the Company's customer care agent who will contact you to arrange a replacement.
The Company will verify whether the correct SKU is available in inventory. If available, the replacement will be prepared and dispatched, and you will receive a new OTP for delivery confirmation. If the correct SKU is not available at the time of the return request, the Company will advise you of next steps. The returned Device must be in its original condition as received.
7.2 Warranty Claims
Devices sold through the Platform are subject to the warranty terms provided by the relevant manufacturer and/or the Company. To submit a warranty claim:
- log a warranty claim request through your account;
- the Company will assess whether your claim falls within the applicable Terms and Conditions of the warranty;
- claims falling outside the warranty Terms will be rejected and you will be notified accordingly; and
- if verified, the Device will be either repaired or replaced at the Company's discretion and returned to you upon completion.
Warranty claims will not be considered in respect of physical damage caused by misuse, unauthorized modification, liquid damage, or damage arising from use other than in accordance with the manufacturer's instructions.
7.3 Late Delivery
If your order has not been delivered within the confirmed delivery timeline, you may notify the Company's customer care team. The Company will liaise with its logistics partner to determine the delivery status and will:
- if delayed: provide an updated delivery timeline, and take steps to expedite delivery; or
- if not delayed: provide you with the current delivery status.
The Company's liability for late delivery is limited to taking reasonable steps to expedite delivery or, where delivery cannot be completed within a reasonable additional period, may consider cancelling the order and initiating a deposit refund within 10 working days.
8. RATINGS AND REVIEWS
Following receipt of your Device, you may submit a product rating and review through your account profile under the "Rating and Reviews" section. By submitting a review, you:
- confirm that the review reflects your genuine experience with the product;
- grant the Company a non-exclusive, royalty-free license to publish, display, and reproduce your review on the Platform and in its marketing materials;
- warrant that your review does not contain unlawful, defamatory, abusive, discriminatory, or otherwise harmful content; and
- acknowledge that the Company reserves the right to moderate, remove, or decline to publish any review that violates these standards.
9. DATA PROTECTION AND PRIVACY
The Company processes your personal data in accordance with the Kenya Data Protection Act, 2019 and its subsidiary legislation. By registering and transacting on the Platform, you consent to the collection and processing of your personal data for the following purposes:
- account registration and identity verification (including IPRS verification);
- credit and eligibility assessment;
- order processing, delivery, and customer support;
- device financing administration and installment tracking;
- compliance with legal and regulatory obligations; and
- communications, including transactional notifications and service updates.
Your personal data will not be sold to third parties. Data may be shared with logistics partners, payment processors, government verification systems, and regulatory authorities as required. For full details, please refer to the Company's Privacy Policy available on the Platform. You may exercise your data rights (access, correction, deletion, and objection) by contacting the Company at the details provided in Clause 16.
10. INTELLECTUAL PROPERTY
All intellectual property rights in the Platform, including but not limited to the E2G brand name, logo, website design, software, content, and trademarks, are owned by or licensed to the Company. Nothing in these Terms grants you any license or right to use the Company's intellectual property, except as necessary for normal use of the Platform. Unauthorized copying, reproduction, or use of any Platform content is strictly prohibited.
11. PROHIBITED CONDUCT
You agree that you will not:
- provide false, inaccurate, or misleading information at any stage of registration or ordering;
- use another person's identity or credentials to access the Platform;
- tamper with, reverse-engineer, or attempt to circumvent the device locking or control mechanisms;
- resell, transfer, or encumber a Device that is subject to an active Installment Plan without the Company's prior written consent;
- use the Platform for any unlawful purpose;
- engage in conduct that disrupts, damages, or impairs the Platform or other users' access to it; or
- attempt to gain unauthorized access to the Platform or its systems.
Violation of any prohibition under this Clause may result in immediate account suspension, termination of the Installment Plan, device recovery, and legal action.
12. DISCLAIMERS AND LIMITATION OF LIABILITY
12.1 Platform Availability
The Platform is provided on an "as available" basis. The Company does not warrant uninterrupted or error-free access to the Platform and shall not be liable for any loss or damage arising from Platform downtime, technical errors, or third-party service disruptions.
12.2 Device Descriptions
The Company endeavors to ensure that Device descriptions, images, and specifications are accurate. However, minor variations between product listings and the actual Device may occur. The Company does not warrant that product descriptions are free from error.
12.3 Limitation of Liability
Fully permitted by applicable law, the Company's aggregate liability to you for any claim arising out of or in connection with these Terms or your use of the Platform shall not exceed the total amount paid by you to the Company in the three (3) months immediately preceding the event giving rise to the claim.
The Company shall not be liable for any indirect, consequential, special, or punitive loss or damage, including loss of data, loss of profit, or loss of opportunity, whether arising in contract, tort, or otherwise.
13. CANCELLATION AND REFUNDS
13.1 No Cancellation after Dispatch
Once a Device has been dispatched, cancellation of the Order shall not be permitted except strictly in accordance with:
- the wrong delivery provisions; or
- warranty provisions set out in Clause 7.
13.2 Limited Grounds for Returns at Delivery
Returns or cancellation requests at the point of delivery shall only be accepted where:
- the Device delivered is incorrect and does not match the confirmed Order; or
- the Device is damaged, defective, or not in a saleable condition at the time of delivery.
The Customer must notify the delivery agent immediately and refuse acceptance of the Device at the point of delivery for such claims to be valid.
13.3 Excluded Grounds for Cancellation or Refunds
For the avoidance of doubt, returns, cancellations, or refund requests shall not be accepted in the following circumstances:
- change of mind by the Customer;
- preference for a different Device, model, colour, or specification;
- the Customer no longer requires the Device; or
- any other reason not expressly provided for under this Agreement.
In such cases, the Order shall be deemed duly fulfilled, and the Deposit shall be strictly non-refundable.
13.4 Failure to Complete Delivery Confirmation
Where the Customer, without reasonable cause, fails or refuses to complete delivery confirmation using the designated Delivery Code upon successful delivery, the Order shall be deemed fulfilled, and:
- the Company shall have no obligation to accept cancellation; and
- the Deposit shall not be refundable.
13.5 Company-Initiated Cancellations
The Company reserves the right to cancel an Order prior to delivery in the following circumstances:
- stock unavailability;
- manifest pricing or system error; or
- failure by the Customer to meet eligibility or verification requirements.
In such cases, the Company shall refund the Deposit in full within ten (10) Working Days, and such refund shall constitute the Customer's sole remedy.
13.6 Refund Processing
All approved refunds shall:
- be processed using the original payment method or such other method as the Company may determine; and
- be subject to internal verification and fraud prevention checks.
14. AMENDMENTS TO THESE TERMS
The Company reserves the right to amend these Terms at any time. Amendments will be posted on the Platform with the updated effective date. Your continued use of the Platform after the effective date of any amendment constitutes your acceptance of the revised Terms. It is your responsibility to review the Terms periodically. Where an amendment materially affects your rights, the Company will use reasonable endeavors to notify you via your registered email address or account inbox.
15. GOVERNING LAW AND DISPUTE RESOLUTION
15.1 Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Republic of Kenya.
15.2 Disputes
In the event of any dispute arising out of or in connection with these Terms, the parties shall in the first instance attempt to resolve the matter amicably through direct negotiation. If the dispute is not resolved within thirty (30) days of written notice of the dispute, either party may refer the matter to mediation in accordance with the Nairobi Centre for International Arbitration (NCIA) Mediation Rules, or such other mediation framework as the parties may agree.
If mediation fails, the dispute shall be referred to the courts of competent jurisdiction in Nairobi, Kenya.

17. GENERAL PROVISIONS
- Entire Agreement. These Terms, together with the Privacy Policy and any applicable financing agreement, constitute the entire agreement between you and the Company in relation to your use of the Platform.
- Severability. If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
- Waiver. No failure or delay by the Company in enforcing any right under these Terms shall constitute a waiver of that right.
- Assignment. You may not assign your rights or obligations under these Terms without the prior written consent of the Company. The Company may assign its rights and obligations to any successor entity or affiliate.
- Language. These Terms are executed in the English language, which shall be the governing language in the event of any conflict arising from a translation.
ACKNOWLEDGED AND AGREED
By completing registration and/or placing an order on the Platform, the Customer confirms they have read, understood, and agree to be bound by these Terms and Conditions.
